These Website Terms and Conditions (“Terms”) govern your access to and use of the Wyldguard Protection Warranty website, forms, content, and online services collectively referred to as the “Site.”
The Site is operated by Wyldguard Protection Warranty (“Wyldguard,” “we,” “us,” or “our”).
By accessing or using the Site, submitting an inquiry, applying to become a partner, or submitting a warranty claim, you agree to these Terms and acknowledge our Privacy Policy.
If you do not agree to these Terms, do not use the Site.
1. Website Terms Versus Warranty Terms
These Terms govern the use of the Site. They are not the complete terms of any Wyldguard Protection Warranty coverage plan, service agreement, partner agreement, or other contract.
Every Wyldguard Protection Warranty is subject to the written warranty agreement, coverage certificate, policy document, rider, enrollment documentation, inspection requirements, exclusions, limitations, and other terms issued for the covered property.
If information on the Site conflicts with the written warranty agreement issued to a policyholder, the written warranty agreement controls unless applicable law requires otherwise.
Website descriptions, examples, frequently asked questions, pricing references, charts, illustrations, and summaries are provided for general informational purposes and do not expand or modify the written warranty agreement.
2. Limited Express Warranty; Not Insurance
Wyldguard Protection Warranty describes its product as a limited express warranty relating to specified wildlife intrusion, structural repairs, exclusion work, wildlife removal, and other expressly identified services.
Wyldguard Protection Warranty does not offer homeowner’s insurance through the Site. A Wyldguard Protection Warranty is not intended to replace property insurance, liability insurance, flood insurance, casualty insurance, or any other insurance coverage.
Nothing on the Site should be interpreted as insurance, financial, legal, construction, engineering, veterinary, wildlife-management, or other professional advice.
Product classification and legal rights may vary by jurisdiction. Nothing in these Terms limits a right or remedy that cannot legally be waived.
3. Eligibility and Authority
You may use the Site only if you:
- Are at least 18 years old or the age of legal majority where you live
- Have legal capacity to enter into these Terms
- Use the Site for a lawful purpose
- Provide accurate information
- Are authorized to act on behalf of any property, business, policyholder, or organization identified in your submission
By submitting a warranty claim, you represent that you are the property owner, policyholder, or an authorized agent permitted to submit the claim.
4. Warranty Availability and Activation
Warranty eligibility may depend on factors including:
- Property location and type
- Initial inspection results
- Existing wildlife activity or damage
- Completion of required exclusion or repair work
- Use of approved materials and installation methods
- Participation by a qualified Wildlife Control Operator
- Payment of applicable charges
- Compliance with the written warranty agreement
- Applicable federal, state, and local laws
- Availability of qualified service providers
Submitting an inquiry, requesting an inspection, receiving a quote, or communicating with a Wildlife Control Operator does not automatically activate coverage.
Coverage becomes effective only when all requirements in the applicable written warranty agreement and enrollment documentation have been satisfied and Wyldguard Protection Warranty or its authorized representative has confirmed activation.
5. Warranty Claims
A claim may be submitted through the Site or through another method authorized by Wyldguard Protection Warranty.
Submitting a claim:
- Creates a record of the submission
- Does not establish that the reported condition is covered
- Does not guarantee claim approval
- Does not authorize the policyholder to begin repairs at Wyldguard Protection Warranty’s expense
- Does not waive any inspection, verification, reporting, maintenance, payment, or documentation requirement
- Does not modify the applicable written warranty agreement
Claims are subject to verification, inspection, applicable reporting deadlines, coverage limits, exclusions, approved-material requirements, property-maintenance responsibilities, and all other applicable warranty terms.
Unless an emergency threatens immediate personal safety or additional serious property damage, do not authorize work for which you expect reimbursement without first obtaining any approval required under the written warranty agreement.
Emergency actions should be limited to reasonable measures necessary to protect people and prevent additional damage. Keep photographs, invoices, reports, and other records of any emergency work.
6. Reporting Wildlife Activity and Damage
Policyholders are responsible for reporting suspected wildlife activity, structural breaches, and damage within the reporting period stated in the applicable written warranty agreement.
Information submitted through the Site must include the date the issue was first detected as accurately as reasonably possible.
Failure to report a condition within the applicable reporting period may affect coverage, subject to the written warranty agreement and applicable law.
7. Accuracy of Information
You agree to provide complete, current, and accurate information.
You must not:
- Misrepresent the date damage or wildlife activity was first detected
- Misrepresent the identity of the policyholder or property owner
- Submit photographs from a different property or incident
- Alter photographs or documents in a misleading manner
- Conceal prior damage, repairs, wildlife activity, or excluded conditions
- Submit a claim for work or damage that you know is not covered
- Impersonate another person or business
- Submit information without proper authorization
Wyldguard Protection Warranty may request additional documents, photographs, inspections, statements, estimates, reports, or other reasonably necessary information to evaluate a submission.
Fraudulent, misleading, or materially incomplete information may result in claim denial, suspension or cancellation of Site access, referral to appropriate authorities, or any other remedy available under the applicable agreement or law.
8. Photographs, Documents, and Other Submissions
You retain ownership of photographs, messages, documents, and other content you submit through the Site.
By submitting content, you grant Wyldguard Protection Warranty and its service providers a nonexclusive, worldwide, royalty-free license to access, store, copy, reproduce, review, transmit, and use that content as reasonably necessary to:
- Respond to your inquiry
- Verify and administer a warranty or claim
- Coordinate inspections and covered work
- Communicate with Wildlife Control Operators, inspectors, contractors, and professional advisers
- Detect fraud or misuse
- Maintain business and legal records
- Comply with legal obligations
- Establish, exercise, or defend legal rights
This license continues for as long as reasonably necessary for those purposes.
You represent that you have the right to submit the content and that its submission and permitted use will not violate another person’s privacy, intellectual-property, contractual, or other legal rights.
Do not upload unlawful, threatening, deceptive, defamatory, malicious, obscene, infringing, or irrelevant material.
9. Wildlife Control Operators and Other Service Providers
Wyldguard Protection Warranty administers services through Wildlife Control Operators and may coordinate with inspectors, repair contractors, exclusion professionals, material providers, and other service providers.
A provider’s participation in the Wyldguard Protection Warranty network does not eliminate the provider’s independent legal, licensing, safety, workmanship, tax, employment, or professional obligations.
The responsibility of Wyldguard Protection Warranty and each service provider is governed by the applicable warranty, partner agreement, work authorization, and law.
You must not rely solely on the Site to address an immediate danger involving an aggressive animal, fire risk, damaged electrical wiring, structural instability, hazardous waste, or another emergency. Contact the appropriate emergency service, utility provider, licensed professional, or local authority.
10. Communications
By providing contact information, you authorize Wyldguard Protection Warranty and parties assisting with your inquiry, warranty, inspection, or claim to contact you through the information provided.
Communications may include email, telephone calls, voicemail, or text messages when reasonably related to:
- Your inquiry
- Warranty enrollment or administration
- Inspection scheduling
- Claim investigation
- Wildlife removal
- Repair or exclusion work
- Documentation requests
- Service-provider coordination
- Legal, security, or account notices
Providing a telephone number through a claim or contact form does not automatically provide consent for unrelated automated promotional calls or text messages.
11. Acceptable Use
You may not:
- Use the Site for an unlawful or fraudulent purpose
- Attempt to gain unauthorized access to the Site, server, forms, accounts, or data
- Introduce malware, harmful code, automated attacks, or disruptive technology
- Scrape, copy, harvest, or collect information through unauthorized automated means
- Interfere with Site operation or security
- Circumvent access restrictions
- Submit spam or unauthorized advertising
- Use the Site to threaten, harass, defame, or harm another person
- Infringe intellectual-property or privacy rights
- Falsely represent an association with Wyldguard Protection Warranty
- Copy or commercially exploit Site content without authorization
- Use Wyldguard Protection Warranty’s name, logo, materials, or content to market an unauthorized product or service
Wyldguard Protection Warranty may restrict or terminate access when it reasonably believes a user has violated these Terms.
12. Intellectual Property
The Site and its content, including text, graphics, photographs, logos, branding, icons, page designs, videos, downloadable materials, databases, and software, are owned by or licensed to Wyldguard Protection Warranty and are protected by applicable intellectual-property laws.
Wyldguard Protection Warranty grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for lawful personal or internal business purposes.
You may not reproduce, modify, distribute, sell, license, publish, display, create derivative works from, or commercially exploit Site content without prior written permission, except where applicable law permits otherwise.
“Wyldguard Protection Warranty,” its logos, and associated branding may not be used without authorization.
13. Third-Party Links and Services
The Site may link to third-party websites, professional organizations, Wildlife Control Operators, contractors, social-media platforms, or other services.
Links are provided for convenience and do not necessarily constitute endorsement, sponsorship, control, or responsibility.
Wyldguard Protection Warranty is not responsible for the content, availability, security, accuracy, privacy practices, or terms of a third-party website or service.
Your interactions with third parties may be governed by separate agreements.
14. Website Availability and Accuracy
Wyldguard Protection Warranty attempts to provide useful and accurate information but does not guarantee that:
- The Site will always be available or uninterrupted
- Every page will be error-free
- All information will always be complete or current
- Every form submission will be successfully transmitted
- Every Wildlife Control Operator will be available in every geographic area
- A particular claim will be approved
- A particular repair method or material will be suitable for every property
- The Site will be free from harmful components
You should retain copies of important submissions and supporting documents.

15. Disclaimer of Website Warranties
To the fullest extent permitted by law, the Site is provided on an “as is” and “as available” basis.
Wyldguard Protection Warranty disclaims warranties relating specifically to the operation of the Site, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, availability, and accuracy.
This Website disclaimer does not eliminate, reduce, or modify an express obligation contained in a valid written Wyldguard Protection Warranty agreement and does not disclaim a right that cannot legally be disclaimed.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Wyldguard Protection Warranty and its owners, officers, employees, agents, licensors, and Site service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damage arising solely from your use of, or inability to use, the Site.
This may include loss resulting from:
- Website interruption
- Transmission errors
- Lost electronic submissions
- Unauthorized Site access
- Reliance on general website information
- Third-party websites
- Harmful code introduced by a third party
Nothing in this section limits liability under a valid written warranty agreement, liability for fraud or willful misconduct, or any liability that cannot legally be limited.
17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Wyldguard Protection Warranty and its owners, officers, employees, and agents from third-party claims, damages, liabilities, losses, and reasonable costs arising from:
- Your unlawful use of the Site
- Your violation of these Terms
- Information or content you submit without authorization
- Your infringement of another person’s rights
- Fraudulent or intentionally misleading information submitted by you
This section does not require a consumer to indemnify Wyldguard for Wyldguard Protection Warranty’s own negligence, misconduct, breach of contract, or violation of law.
18. Suspension and Termination
Wyldguard Protection Warranty may suspend, restrict, or terminate access to the Site when reasonably necessary to:
- Protect Site security
- Prevent fraud or misuse
- Comply with law
- Investigate a violation
- Protect Wyldguard Protection Warranty, its policyholders, partners, or the public
Termination of Site access does not automatically terminate, cancel, or modify an existing written warranty agreement unless that agreement expressly provides otherwise.
19. Governing Law
To the fullest extent permitted by applicable law, these Website Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.
Any mandatory consumer-protection right provided by the law of your state of residence remains applicable where it cannot legally be waived.
The governing law, venue, dispute-resolution process, arbitration provisions, and other procedures applicable to a warranty claim or contractual dispute may be separately addressed in the applicable written warranty agreement.
20. Changes to These Terms
Wyldguard Protection Warranty may update these Terms to reflect changes in the Site, services, business practices, or legal obligations.
Updated Terms will be posted with a revised “Last Updated” date. Changes apply prospectively from the date they become effective unless applicable law requires otherwise.
Material changes to an existing warranty agreement will be handled according to that agreement and applicable law. Updating these Website Terms does not retroactively reduce coverage under an existing written warranty.
21. Severability and Waiver
If a provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
A failure by Wyldguard Protection Warranty to enforce a provision does not waive the right to enforce that provision later.
22. Entire Website Agreement
These Terms and the Privacy Policy constitute the agreement between you and Wyldguard Protection Warranty concerning use of the Site.
They do not replace the written warranty agreement, coverage certificate, policy document, rider, partner agreement, work authorization, or other contract applicable to a particular transaction.
